no they are not liable for wrong ratings
one good example is thw S& P gave bad rating on india markets in 2008. where as the market performed very well in 2009. no one has bothered on rating

Rating agencies can be held liable only if they have purposefully mislead investors through fraud.
If the ratings have gone wrong due to unanticipated events then they cant be held liable.
